Peru label requirements: octagons and food labelling

Packaged food sold in Peru carries a label in Spanish under Supreme Decree 007-98-SA and the INACAL labelling standard NMP 001, with the sanitary registration number DIGESA gives each product. Since June 2019 processed food over the thresholds of Ley 30021 also carries black warning octagons on the front. Here is what goes on the pack, and how to lay it out.

Every food label: D.S. 007-98-SA and NMP 001

The label is in Spanish and gives the name of the product, the country where it was made, the net contents, the expiry date, the batch, the ingredients and additives, the name and address of the maker and — for imported food — the name, address and tax number (RUC) of the importer in Peru, the sanitary registration number (Registro Sanitario, “R.S. N°”) and the storage conditions of perishable food. Imported packs may carry the importer’s details on an adhesive label added in Peru.

Non-food manufactured goods follow Ley 28405, the law on the labelling of manufactured industrial products: Spanish, the name of the product, its country of manufacture, its net contents, the maker or importer and any warnings or expiry date.

The warning octagons: Ley 30021

Ley 30021, the law promoting healthy eating of children and adolescents, and its Manual de Advertencias Publicitarias (D.S. 012-2018-SA) ask processed food above set levels of sodium, sugar or saturated fat, or containing trans fat, to show one black octagon with white letters for each: “ALTO EN SODIO”, “ALTO EN AZÚCAR”, “ALTO EN GRASAS SATURADAS” and “CONTIENE GRASAS TRANS”, each with the line “Evitar su consumo excesivo” (“Evitar su consumo” for trans fat).

Thresholds since 17 September 2021

  1. Solid food, per 100 g: sodium 400 mg or more, total sugar 10 g or more, saturated fat 4 g or more.
  2. Drinks, per 100 ml: sodium 100 mg or more, total sugar 5 g or more, saturated fat 3 g or more.
  3. Trans fat: the octagon “CONTIENE GRASAS TRANS” whenever the product contains it as the regulation defines.

Where the octagons go, and how big

The octagons sit on the front face of the pack, in its upper right part, and the Manual sets their size by the area of that face. A pack whose front face is under 50 cm² does not carry them itself; the box or bag it is sold in does. INACAL’s guide GP 110:2022 explains how to place them on each kind of pack. Use the official artwork from the Manual at the size its table gives — never redraw or recolour it, and never put text or pictures over it.

Laying it out in Drint

  1. In the studio, click Insert → Product label and choose the market Perú and the goods group.
  2. Paste the client’s Spanish as they wrote it — Drint does not translate — and the R.S. number as it reads on the DIGESA certificate.
  3. Type sodium, sugar and saturated fat per 100 g or 100 ml: the label tells you which octagons the product needs, and places a frame for each official file in the upper right of the front face.
  4. Choose printed on the pack, or an adhesive label for the importer’s details on an imported pack.
  5. Check in Export lists the items still missing; export the CMYK PDF/X-4 with the die on its own layer for your printer.

Questions

Does every food in Peru need octagons?

No. Only processed and ultra-processed food whose sodium, sugar or saturated fat per 100 g or 100 ml reaches the thresholds, or that contains trans fat. Fresh food, and food with no added sodium, sugar or fat, carries none.

Can an imported product use stickers for the octagons?

Peru allowed adhesive octagons on imported products and on small local firms’ packs for a period that ended on 31 March 2022. Today print them on the pack; an adhesive label is still used for the importer’s details.

What is the R.S. number?

The Registro Sanitario that DIGESA gives each processed food or drink, imported or made in Peru, before it is sold. It is printed on the label as “R.S. N°” followed by the number on the certificate.

Is a nutrition table required?

The octagons are worked out from the nutrient values, so the maker needs them; a nutrition table on the label is expected when the pack makes nutrition or health claims. Ask your client’s regulatory adviser what their product category needs.

A summary written to design packs, not legal advice. Check the current texts — Ley 30021, D.S. 017-2017-SA, D.S. 012-2018-SA and D.S. 007-98-SA in El Peruano — and the product’s DIGESA registration with your client or importer before printing.
